Dad Shoots Daughter's Laptop Over Facebook Post [VIDEO] (Mashable)


The disgruntled teenage daughter of a tech-savvy, gun-toting father just got a very public lesson in respecting one's elders.

"That right there is your laptop," the father, named Tommy Jordan, says in a YouTube video while pointing a video camera at a computer on laying in a patch of dirt and grass. "This right here is my .45," he says, moving a pistol into the frame.

He cocks the weapon and shoots nine exploding hollow-point rounds into the laptop.

Okay, rewind.

Jordan's 15-year-old daughter apparently wrote a Facebook post complaining about the chores she has to do at home and the overall hassle that her parents make her life. The father took exception to the public airing of grievances, and so decided to exact his own bit of public revenge, according to the video description, as well as Facebook and Reddit posts he appears to have made.

The role of social media in family life has been debated since social networks began to catch on, but Jordan appears to be taking a proactive approach.

In the video, which is titled "Facebook Parenting: For the troubled teen." and looks to be shot from a tripod, Jordan sits down in a chair outdoors with a computer print-out in hand. He dedicates the recording to his daughter and, "more importantly for all her friends on Facebook who thought that her little rebellious post was cute, and for all you parents out there who think your, you know, kids don't post bad things on Facebook."

Jordan says he works in IT for a living (and, indeed, appears to run a company called Twisted Networx) and chastises his daughter for thinking she could hide the note from him with privacy settings. He then reads the purported note aloud after explaining, "since you want to hide it from everyone, I'm going to share it with everybody."

In the note, the daughter says that she should be paid for the chores she does and her parents overwork her, criticizing them harshly. Jordan says that her complaints are mostly unjustified, and contrasts it to the work he had to do growing up.

After about seven minutes of preamble, he gets up from the chair and plugs the computer full of lead.

Jordan writes in the video description: "Maybe a few kids can take something away from this... If you're so disrespectful to your parents and yourself as to post this kind of thing on Facebook, you're deserving of some tough love. Today, my daughter is getting a dose of tough love."

Mashable has attempted to contact Jordan for further comment, but so far has not received a response.

Allowing Your Children a Choice. Selecting activities your children will enjoy is what you want to try as best as possible. Allow Quiet Time. Allow some portion of the day/week/month where your children don?t have to do anything. Essential components for a child?s development include introspection and time for simply exploring.

All of us are well meaning parents in the long run. But to be a good parent, this will not depend on the number of activities that they involve their children each and every day.

A good parent is one that allows their children the opportunity to explore many different things without forcing many different things on their kids.

This was a personal injury case in which a dispute arose as to whether proceedings had been issued within the time limited by the Statute of Limitations (taking into account the provisions of section 50 of the Personal Injuries Assessment Board Act, 2003).

In practice I have not found it uncommon to receive panicked telephone calls from solicitors worried that the limitation period is about to run out. This panic is usually induced by a misunderstanding of the provisions of section 50 of the 2003 Act.

Section 3(1) of the Statute of Limitations Amendment Act, 1991 as amended by section 7(A) of the Civil Liability and Courts Act, 2004 provides that an action for personal injuries caused by negligence shall not be brought after the expiration of two years from the date on which the cause of action accrued or the date of knowledge if later.

Section 50 of the Personal Injuries Assessment Board Act, 2003 provides that:-

?In reckoning any period of time for the purposes of any limitation period in relation to a relevant claim specified by the Statute of Limitations 1957 or the Statute of Limitations (Amendment) Act, 1991, the period beginning on the making of an Application under Section 11 in relation to the claim and ending six months from the date of issue of an Authorisation? shall be disregarded?.

If you can imagine a clock ticking from the date on which the cause of action accrued (or the date of knowledge if later), that clock is going to run for two years. Once an application is made to PIAB the clock stops, and only starts to run again after a period of six months has elapsed after an authorisation is issued. In effect this adds to the two year limitation period any period for which the application is in PIAB plus six months. This is not a simple principle to get your head around but it is worth figuring out once and for all.

What was interesting about the Kiernan case was the court?s decision in relation to the date the application had been made. The plaintiff?s solicitors faxed a PIAB application on the 27th May 2009 and posted it on the same date. The fax on the 27th May 2009 included a copy of the cheque which was being enclosed in the post. That cheque was not received by PIAB until the 29th May 2009. PIAB deemed the 29th May 2009 to be the date that the application was made for the purposes of section 50. The High Court disagreed and found that the 27th May 2009 was the appropriate date.

The court held as follows:-

?Examining the ordinary meaning of ?making of an application? the essential components were in place after the fax had been successfully delivered on the 27th May 2007 (sic). The Board had a copy application form and a copy of the medical report. The payment was not made but a copy of the cheque was in the Board?s possession and the cheque was sent by registered post on the 27th May 2009 for the appropriate fee. The Court comes to the conclusion the appropriate date in respect of the making of a claim for the purposes of the Statute was the 27th May 2009.?

Practitioners should accordingly note that, where there is any degree of urgency regarding the making of an application to PIAB, the act of faxing through the completed application together with a copy cheque should be sufficient to ensure the application is deemed complete on that date rather than on the later date when the Board actually receives the cheque.

Property tax may need to rise to pay back bonds | News Blog

If property values don?t start increasing, the state may need to increase property taxes or tap the general fund to pay off its bond debt, legislative analysts told lawmakers.

Legislative analyst Patrick Frank told the House Appropriations Committee that with home values declining, the state is collecting less money to use to pay back bonds.

?If we keep the current property tax rate, I think in 2014, there will be a gap,? State Treasurer Nancy Kopp said. ?And you will have to look at either going to the general fund or raising the property tax.?

Bonds are paid back out using several sources, including property taxes. The general fund, where most of the state?s revenues go, ?has not been used to pay back bonds for almost a decade.

Kopp said that the general fund has historically played a role in paying back bonds. In 2003, that burden was shifted to property taxes, and the Board of Public Works raised state property tax rate so the money would be there.

In 2010, Kopp said, the board reduced the property tax rate. With lower property taxes and homes worth less, the money is running short.

Frank said that while general fund revenues could be used to pay back bonds, it is not what he would recommend.

?Our issue really is that there?s a long term deficit in the general fund and this is adding to it, so we?d like to reduce that,? Frank said.

The property tax is currently 11 cents for each $100, Kopp said. Right now, a penny of property tax brings in $68 million.

Frank said that it appears that home values are beginning to level off, and the state will be losing fewer revenues to property tax exemptions.

?Perhaps we?ll eventually get to the point where there is no downgrade,? Frank said.

Frank showed delegates a chart that showed how much revenue the state was losing through homestead tax exemptions ? a tax credit for people who live in their homes and see their property values increasing.

The homestead tax exemption softens the blow to homeowners of sharp increases in property values and also provides a hedge for state revenues, Frank said. Because property owners are not paying so much more, the state does not suffer as quickly if property values fall.

Del. Gail Bates, R-Howard, asked if rolling back the homestead exemption could help with the financial issues. Frank said that would take too long to make the necessary impact.

?Ultimately, yes, you?d have to increase the rate,? he said.

The Language of Reconciliation is one that must be spoken with the Accent of Peace.? Reconciliation among ethnic groups cannot be achieved unless those on all sides are willing to recognize the language spoken beyond the accent or the variables of dialect (cultural framework) in which it is spoken.

?Language is when gestures & words go together. When people use gestures to supplement our worlds, to provide a deeper understanding of what we are communicating. Language-(the primary way in which people communicate with one another) is a system of symbols that can be strung together in an infinite number of ways for the purpose of communicating abstract thought.

What may be most surprising is that many times what?are viewed as differences are not. Dialectical differences of syntax or word usage can cause confusion or even conflict when it need not be. In essence people of the same language may be saying the very same thing but simply in a different way.?

In a Walgreens story on facebook the; drug store chain featured a study on how different regions refereed to carbonated soft drinks. ?The Great Pop vs. Soda Controversy on the internet, mapped out these various Dialectical differences of describing this one beverage. It is a good thing; stereotypes, profiling, dissention, and racism are not used in these cases of language diversity.

?In order to achieve reconciliation in face to face communication between people, ?Self? should not be a means to an ends nor can it be an end unto its self. The concept of ?Self? is one that is far too subjective. When attempting to bridge groups and individuals into a dialog of reconciliation across ethnic boundaries, God?s faithfulness and His trustworthy qualities must be replicated into an atmosphere conducive to Christ? centered Social Capital.

The Language of Reconciliation is the key in building enough of this Capital to produce real clout i.e. change; in Churches, the Workplace, Communities, and Society at large. This language chooses its? symbols carefully and the selections of words that are used, are actually thought out. It doesn?t speak with voices of Stereotypes, racism or dissention.

?This language does not cower into a bland, homogenous depiction of a surface level reconciliation that only adds more questions than answers; nor does its? speaking, disguise mere Political Correctness.

? ?The value placed upon faithfulness has social implications? [It] is an important aspect of trustworthiness and hence the foundation of the trust which is essential for efficient multi -ethnic relationships.

Faithfulness of this kind also requires truthfulness and in Hebrew thought the word frequently translated ?truth? or ?truthfulness? is almost interchangeable with faithfulness. Will we tend to think of truth as being primarily concerned with propositional accuracy, Hebrew thought emphasized the requirement to be ?true? in character and in the relationships that one has?

The accent of Peace is formed out of the syntax of coalescence i.e. always looking for common ground and bridging any gaps along the way. God?s word further clarifies the accent of peace through simple rules of peaceful engagement in cultivating good cross cultural relationships.

?Welcome with open arms fellow believers who don?t see things the way you do. And don?t jump all over them every time they do or say something you don?t agree with?even when it seems that they are strong on opinions but weak in the faith department. Remember, they have their own history to deal with. Treat them gently.?? Romans 14:1 The Message (MSG)

The cultural makeup (norms, values, sanctions, folkways and taboos etc.) of various ethnic groups can be used as transitional Phrases of thought or logic, replacing the marginalizing boundaries of dissection, therefore allowing the Language of Reconciliation to speak in the Accent of Peace.

?For instance, a person who has been around for a while might well be convinced that he can eat anything on the table, while another, with a different background, might assume he should only be a vegetarian and eat accordingly. But since both are guests at Christ?s table, wouldn?t it be terribly rude if they fell to criticizing what the other ate or didn?t eat? God, after all, invited them both to the table. Do you have any business crossing people off the guest list or interfering with God?s welcome? If there are corrections to be made or manners to be learned, God can handle that without your help.?

Romans 14:2-4 The Message (MSG)

The Accent of Peace involves respectful communication which is a unifying vehicle, to use the essence of God?s truth through his word. It is? to be relevant and empathetic between parties.

it?is not compromise on God?s standards of moral and ethical character. Word choices?are not be accusatory or use non respectful language. Respectful Communication?is an invitation to move into deeper understanding of one another by acknowledging our differences. It?is? communication that?challenges it?s participants to stretch outside of their comfort zones.

The words of respectful communication?does not cause participants to lose their identity but they?help all parties seek to enhance their identities in peaceful unity, one to another on all sides of the ethnic/cultural chasm.

German reporter says he was beaten in Iran (AP)

BERLIN ? A German reporter says he was beaten by guards during his nearly five months of imprisonment in Iran and that he heard constant, "horrible cries" of other inmates being tortured.

In the first public comment since being freed a year ago, Marcus Hellwig told the Sunday mass-circulation tabloid Bild am Sonntag he was regularly beaten and constantly interrogated during the first 10 "brutal" days in captivity until a German diplomat intervened.

"Sometimes they claimed that I was a spy, then allegedly a terrorist," he was quoted as saying. "They wanted to unsettle me with their never-ending questioning, wanted to put me under psychological pressure and create an ambiance of fear," he said.

Hellwig and German photographer Jens Koch ? both working for Bild am Sonntag ? had entered Iran on tourist visas and were detained in October 2010 after interviewing the son of Sakineh Mohammadi Ashtiani, an Iranian woman sentenced to death by stoning for adultery.

Her case had generated widespread international outrage.

The two journalists were freed a year ago after German Foreign Minister Guido Westerwelle traveled to Tehran for a rare meeting with Iranian President Mahmoud Ahmadinejad, then brought the pair home on his government plane.

Iranian resistance groups later criticized Westerwelle's Tehran visit as a propaganda victory for the Iranian regime.

Hellwig said that prison guards, in an apparent move to frighten him, took him "to a torture cell to show me what they were using there to torture people."

"I was beaten. And there were some other things, but I do not want to talk about them," he said.

Hellwig told the newspaper another torture cell was located near where he and Koch were being held and that they heard its victims throughout the day. "The cries were horrible," the reporter said.

In Tehran, Iranian judiciary officials were not immediately available on Sunday to comment on Hellwig's account of his captivity.

Hellwig said he and the photographer knew that reporting from Iran with tourist visas "would not be without danger, but I had hoped to minimize the risk with good preparation."

Last year, the Iranian judiciary found the pair guilty of committing unspecified acts against Iran's national security. But a court then threw out the journalists' 20-month prison sentence, commuting it to a $50,000 fine.

Hellwig said he and Koch were shocked when prison guards suddenly told the two journalists they were free to go and gave them back their personal belongings. "I only felt free when the government plane left the Iranian airspace heading to Turkey," Hellwig was quoted as saying.

He has written a book about his ordeal entitled "Inshallah. Captive in Iran," which will be published in German later this month. Inshallah is Arabic for "God willing."

Meanwhile, Ashtiani ? who was convicted of adultery in 2006 following the murder of her husband ? remains behind bars in Iran and authorities said in December she may be hanged. In July 2010, Iran suspended plans to carry out her death sentence by stoning following an international outcry about the case.

Before I embark on a brief exploration of whether clinical legal education can provide a solution to two difficulties facing the legal profession in Canada today, I must first make a disclosure. I am a big proponent of clinical legal education and as the incoming director of an excellent clinical program at the University of Victoria I have witnessed first hand the numerous benefits that this manner of education can have to students, the profession and the community as a whole. This experience allows me to approach this discussion not only from the perspective of a lawyer and consultant who has an interest in the future of the legal profession, but also from the point of view of an academic. In my experience it is often the disconnect between these two perspectives that is a cause for conflict and I hope in this discussion to move past this issue and establish that the expansion of legal clinics in Canada are in the interests of both the profession and the academy.

Before I embark on this discussion however, it is useful to provide some background. Clinical legal education took root in North American in the early 20th century when the first law schools in the United States recognized the need to supplement the case book method of legal education with the type of practical experience gained through the apprenticeship model that was the predominant legal education model in Europe at the time. This led to early clinics being established at universities such as Northwestern Law School and Yale. In the years following, law school clinics expanded throughout the United States and have since become an integral component of the law school curriculum across the country. The history of law school clinics in Canada reveals that their development is much more recent and in this country the integration of legal clinics into law schools has been a slow and measured process. Despite this, there are currently a variety of excellent legal clinical programs found at law schools across the country including the Business Law Clinic, Environmental Law Clinic and Law Centre at the University of Victoria, the Law Students Legal Advice Program at the University of British Columbia, the Osgoode Hall Community and Legal Aid Services, the University of Toronto Downtown Legal Services and many others.

In addition to the existence of numerous clinics across the country, the recognition that Legal Clinics have an important role to play in the education of young lawyers in Canada can be seen by the recent establishment of the Association for Canadian Clinical Legal Education. This organization, composed of clinical legal educators from across the country, was formed in part to provide a forum for legal educators to share best practices and to encourage the promotion and improvement of clinical legal education in Canadian Law Schools. Having witnessed first hand the many positive aspects of clinical legal education through my involvement with the Business Law Clinic at the University of Victoria I share the enthusiasm of the Association for clinical legal education and feel that this type of education experience can assist the profession in dealing with a number of pressing issues including calls from the profession for better-prepared students and the delivery of legal services to those who may not otherwise be able to access them.

Calls from the legal profession for better-prepared students ? There is a growing voice within the legal profession in Canada for changes in the manner that law students are educated. This voice arises from the feeling that students are sometimes not adequately prepared to take on the duties of an articled student and eventually called lawyer once they have completed their legal education. While this perspective may be contentious, it is my personal opinion that there is a valid point to be made regarding the preparation of law students that must be explored. Movement towards setting some minimum standards across the country for legal education are afoot with the Federation of Law Societies of Canada recently proposing a new set of standards to ensure the entry level competence of newly called lawyers that includes the introduction of certain required courses at law school. These standards have been met with criticism from academics who, among other points, maintain that it is not the role of the profession to dictate the educational standards of law schools.

While this may be a valid perspective, it is my point of view that law schools in Canada should not be blind to the fact that the overwhelming majority of their graduates join the profession and have come to law school with the express purpose of learning the skills necessary to do so. In this regard, clinical legal education for upper level students can play a valuable role in preparing students for practice. Law school clinics allow students to apply the theoretical knowledge that they have obtained through class work in a safe and properly supervised environment. This practical application not only strengthens the lessons learned in foundational courses, but also allows students exposure to areas such as ethics that are difficult to fully appreciate in the abstract.

I am very curious to hear the perspectives of those in the SLAW community regarding the role of clinical legal education in Canada and encourage comments below to share your thoughts.
